No bail for 55-year-old lawyer in POCSO case

MUMBAI: An additional sessions judge, Surekha Patil, on Thursday rejected a bail plea filed by a who was arrested last December in a case registered under the Protection of Children from Sexual Offences Act () for raping a minor who he said he had “married.’’
Appearing for the accused, his counsel Sanjeev Kadam argued that bail be granted as the probe is over and chargesheet filed. Kadam accepted that a “marriage’’ performed in front of several witnesses by the accused advocate when the victim was 14 years old can “itself be termed illegal’’ but said that he had not stopped her from getting higher education and had gifted her six acres land.

He said she had complained only when they moved to Mumbai and the accused undertakes not to enter the taluka where she now resides. The prosecutor R S Kanojia however opposed the bail plea saying he knew the law, had “full knowledge of her being a minor’’ and yet had “fraudulently performed’ attracting offences under section 496 of too apart from violating the Marriage Act. The girl was born in September 2000 and is still a minor. She has also alleged that he physically abused her.
